Constitutional Showdown: Executive Power vs. Judicial Activism in Border Security

The Constitutional Showdown over border security has reached a boiling point. Although the U.S. Constitution assigns immigration enforcement to the Executive Branch, courts—both federal and state—are increasingly seizing control. This week, we expose how judges are obstructing the President’s lawful authority to secure the nation’s borders, and how sanctuary states and cities are defying federal immigration enforcement altogether.

What the Constitution Says About Executive Border Authority

Article II of the U.S. Constitution charges the President with ensuring that the laws of the land are faithfully executed. Federal immigration laws grant the Executive Branch broad authority to detain, deport, and bar illegal entry. From a biblical standpoint, borders and national distinctions reflect God’s sovereign order—’He determined allotted periods and the boundaries of their dwelling place’ (Acts 17:26).

When judges override that authority, they not only usurp the constitutional balance of powers, but also undercut the government’s God-given duty to protect its people and enforce justice (Romans 13:1–4).

Judges Blocking Federal Enforcement at the National Level

Recent court decisions have tied the hands of federal immigration officers and stripped the President of his ability to carry out laws passed by Congress. In Texas v. United States, federal courts blocked efforts to prioritize deportations for convicted criminals and repeat offenders. Similarly, judges have intervened to halt border wall construction, parole restrictions, and asylum reforms—all policies backed by electoral mandates and statutory authority.

Sanctuary States and Local Courts Join the Resistance

State-level defiance compounds the crisis. Sanctuary cities like New York, Los Angeles, San Francisco, and even Richmond, Virginia, have implemented local policies that prohibit cooperation with federal immigration authorities. In some cases, state judges have ordered local jails to ignore ICE detainers, releasing violent offenders back into communities. Check this map to see if your location is a sanctuary.

These decisions, framed as compassionate, in fact undermine lawful government. Scripture warns against those ‘who call evil good and good evil’ (Isaiah 5:20) and reminds us that ‘justice is turned back, and righteousness stands far away’ (Isaiah 59:14).

If unelected judges can override the Executive’s constitutional role, then elections cease to matter. If state courts and city councils can shield lawlessness from federal reach, then national sovereignty crumbles. This isn’t merely a political debate—it’s a fundamental battle over who governs, how laws are enforced, and whether God-ordained order will stand.
