New Executive Order Targets Biden-Era Gun Restrictions, Pledges Full Protection of Gun Rights

On February 7, 2025, President Trump issued an executive order titled “Protecting Second Amendment Rights.” This order underscores the Second Amendment as a fundamental safeguard of security and liberty, emphasizing its role in allowing Americans to protect themselves, their families, and their freedoms.

Key directives of the executive order include:

  1. Comprehensive Review by the Attorney General: Within 30 days, the Attorney General is tasked with examining all executive actions, regulations, guidance, plans, international agreements, and other agency actions to identify any ongoing infringements on Second Amendment rights.

  2. Specific Areas of Focus: The review will cover:

    • Presidential and agency actions from January 2021 through January 2025 that, while promoting safety, may have impinged on the Second Amendment rights of law-abiding citizens.
    • Rules promulgated by the Department of Justice, including those by the Bureau of Alcohol, Tobacco, Firearms, and Explosives, during the same period, pertaining to firearms and Federal firearms licensees.
    • Agencies’ plans and actions regarding the “enhanced regulatory enforcement policy” related to firearms and Federal firearms licensees.
    • Reports and related documents issued by the White House Office of Gun Violence Prevention.
    • The positions taken by the United States in ongoing and potential litigation affecting Americans’ ability to exercise their Second Amendment rights.
    • Agencies’ classifications of firearms and ammunition.
    • The processing of applications to make, manufacture, transfer, or export firearms.
  3. Development and Implementation of a Plan of Action: Following the review, the Attorney General will collaborate with the Domestic Policy Advisor to finalize and implement a plan to protect Second Amendment rights.

This executive order represents a significant shift in federal policy concerning gun rights, aiming to reassess and potentially reverse actions from the previous administration that may have been perceived as restrictive. It reflects the administration’s commitment to upholding the Second Amendment and ensuring that federal actions do not infringe upon the rights of law-abiding citizens.

This move comes in the context of ongoing national debates about gun control and Second Amendment rights. Notably, the Supreme Court’s decision in New York State Rifle & Pistol Association, Inc. v. Bruen two and a half years ago significantly changed gun laws in the United States, establishing a new standard wherein governmental regulations must align with historical gun laws.

Additionally, in September 2024, President Biden signed an executive order targeting new gun technologies, aiming to restrict technologies that make guns easier to use and obtain, and addressing the trauma caused by active shooter drills in schools.

The current executive order seeks to reassess such actions to ensure they do not infringe upon Second Amendment rights.
