America is facing a defining moment—a tipping point where the balance of power between government branches is dangerously altered. The rise of judicial overreach, driven by unelected district judges, has created a constitutional crisis that threatens the foundation of our republic and, ultimately, the rule of law.

This isn’t just a political issue. For Christians who believe in God-ordained authority and biblical justice (Romans 13:1–4), we are witnessing the unraveling of a system designed to protect liberty, order, and moral governance under God.

Weaponizing the Bench: A New Form of Lawfare

Legal scholars now use the term lawfare to describe how courts are used as weapons, not arbiters of justice. Instead of interpreting law, activist judges are increasingly shaping policy and obstructing the electorate’s will.

Consider this: During President Trump’s first term, courts issued 64 nationwide injunctions—more than any president in history. Since January 2025, 15 more injunctions have already been handed down against the current administration in just six weeks. These rulings often bypass legislative debate and halt lawful executive action, replacing democratic decision-making with judicial fiat.

For those who cherish constitutional checks and balances, this signals a deep crisis.

Newt Gingrich’s Stark Warning

In recent congressional testimony, former Speaker Newt Gingrich declared:

“There is clearly a potential constitutional crisis involving the judicial branch’s effort to fully override the legislative and executive branches.”

He reminded Congress that America has faced similar challenges before. In 1802, Thomas Jefferson and Congress abolished entire courts packed with partisan judges by President John Adams, reasserting balance through legislative power.

Gingrich’s call is clear: Congress and the President are not powerless. They have a constitutional responsibility to defend their authority against rogue courts, just as the Founders intended.

Case in Point: Judge James Boasberg

One of the most troubling examples is U.S. District Judge James Boasberg, who recently ordered deportation flights to turn around mid-air—directly defying executive authority under the Alien Enemies Act.

Even more concerning:

  • His wife operates an abortion clinic aggressively promoting mail-order access to abortion pills across several states.
  • His daughter is affiliated with a nonprofit heavily funded by government grants.

Boasberg’s attendance at a judicial retreat sponsored by anti-Trump donors only deepens the concern. As former Speaker Gingrich warned, this is not an isolated incident—this is part of a systemic rebellion by the judicial branch.

The Christian Worldview: God’s Order vs. Judicial Chaos

Romans 13 tells us that governing authorities are established by God—not by unelected judges acting on ideology. When courts overstep their bounds, they rebel not just against the Constitution, but against the moral framework of divine order.

As Christians, we must defend the integrity of just governance. The balance of powers exists to protect against tyranny, whether from kings—or from black-robed oligarchs.

What Can Be Done?

Gingrich offered a biblical and constitutional solution:

  • Congress must reassert authority by passing laws like the No Rogue Rulings Act to curtail activist injunctions.
  • The Supreme Court, led by Chief Justice Roberts, should immediately review and suspend any district court rulings that attempt to override executive action on national security.
  • The people—especially the Christian community—must stay informed and prayerfully engaged. We are called to be watchmen (Ezekiel 33:7), sounding the alarm when the nation’s foundations are under threat.

Conclusion: A Call to Action Before It’s Too Late

If Democrats regain the House in 2026, this judicial overreach may become permanent, locking in a system that mocks accountability and overrides the will of the people. We may never again have the opportunity to reverse course.

Now is the time to speak truth with love, to act with courage, and to pray for the restoration of a just government that honors God and the Constitution.
